AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA), Department of Transportation (DOT)ACTION: Proposed rule; extension of comment periodSUMMARY: On 27 June 2023, PHMSA published a notice of proposed rulemaking, titled "Hazardous Materials: FAST Act Requirements for Real-Time Train Consist Information (HM-263)," proposing amendments to the Hazardous Materials Regulations to require all railroads to generate in electronic form, maintain, and provide to first responders, emergency response officials, and law enforcement personnel, certain information regarding hazardous materials in rail transportation to enhance emergency response and investigative efforts. In response to a request for an extension of the comment period submitted by the American Short Line and Regional Railroad Association (ASLRRA), PHMSA is extending the comment period for the HM-263 notice by an additional 60 days. Comments to the HM-263 notice will now be due by 27 October 2023.DATES: Comments should be received on or before 27 October 2023. To the extent possible, PHMSA will consider late-filed comments.This proposed rule; extension of comment period and the notice of proposed rulemaking notified as G/TBT/N/USA/2013 are identified by Docket Number PHMSA-2016-0015. The Docket Folder is available on Regulations.gov at https://www.regulations.gov/docket/PHMSA-2016-0015/document and provides access to primary and supporting documents as well as comments received. Documents are also accessible from Regulations.gov by searching the Docket Number. WTO Members and their stakeholders are asked to submit comments to the USA TBT Enquiry Point by or before 4pmEastern Time on 27 October 2023. Comments received by the USA TBT Enquiry Point from WTO Members and their stakeholders will be shared with the regulator and will also be submitted to the Docket on Regulations.gov if received within the comment period.
