Description
The proposed changes notified in G/TBT/N/CAN/687 (dated January 3, 2023) were adopted and published on June 19, 2024, as the Regulations amending the Products Containing Mercury Regulations (the Amendments).The Amendments modify the Products Containing Mercury Regulations (the Regulations) to align with the requirements under the Minamata Convention on Mercury. The Regulations, which came into force in 2015, prohibit the manufacture and import of products containing mercury, with some exemptions for essential products which have no viable alternatives (for example lamps, certain health, safety and research applications and dental amalgam). The Amendments: Lower the allowable mercury content limits of lamps that are exempt from the general mercury prohibition, including straight fluorescent lamps for general lighting purposes;Add prohibition dates for certain mercury-containing products, including the most common types of lamps containing mercury, and for replacement lamps after a transitionary period;Remove other exemptions for products no longer in use in Canada and products whose exemption period has expired.Broaden the scope of the accreditation bodies recognized under the Regulations to include signatories of the International Laboratory Accreditation Cooperation Mutual Recognition Arrangement.Other amendments to the Regulations aim to clarify some provisions of the regulatory text, such as those related to labelling, testing, reporting, and recordkeeping.The Amendments come into force on the first anniversary of the day on which they are published in the Canada Gazette, Part II.
